Rock My World, Inc. (“RMW” or “we” or “us”) is committed to protecting your privacy. This Privacy Policy describes how we collect, store, use, and distribute your Information through our software, web site, documentation, and related services (together, the “Services”).


By using the Services, you consent to our use of your information as described in this Privacy Policy. You may withdraw this consent at any time, however, this may result in your inability to continue using some or all of the Services.


The Services are directed solely to persons 16 years of age or older. We do not knowingly gather information from visitors who are under 16. If we become aware that we have gathered information from a person under 16, then we will attempt to delete such information as soon as possible. Personally Identifiable Information. This means any information which can be used to identify an individual and may include, but is not limited to, name and email address. We collect Personally Identifiable Information from you when you register for the Services. In the future, to participate in certain activities and to obtain certain services or documents offered via the Services, you may be asked to provide additional Personally Identifiable Information such as phone number, billing address and credit card information. We endeavor to limit our requests for Personally Identifiable Information to information we believe is reasonably necessary to achieve our purposes as described in the “Information Use” section below. Any Personally Identifiable Information received in communications or in material you transmit to the Services by electronic mail or otherwise are and will be treated in accordance with this Privacy Policy. When you visit the Services we may also collect non-personally identifiable information, which is information that by itself cannot be used to identify or contact you, such as demographic information (e.g., age or gender) or usage information (such as the browser you are using, the URL that referred you to the Services and the areas of the Services you visit). We may also supplement the information we collect with information from other sources to assist us in evaluating and improving our Services and offerings.

Biometric Information. Certain features of the Services may actively record biometric information about yourself as you use the Services. This tracking is accomplished through integration with your mobile device’s health tracking technology, such as Apple’s HealthKit API or Google Fit, or via other devices, such as FitBit. Such information is referred to as “Biometric Information.”

Usage and Analytics Information. As you use our Services, we may also collect information through the use of commonly-used information-gathering tools, such as cookies, log files, and Web beacons. Such Information may include information regarding your mobile device (such as your device model and unique device id number), browser type, browser language, Operating System, Internet Protocol (“IP”) address, and the actions you take on our web Services (such as the web pages viewed and the links clicked) or while using the Services. Collectively, this information is referred to as “Usage and Analytics Information.”

Geo-Location Information. This means any information regarding your real-time geo-location while using the Services. We will request your permission before collecting such information.


Personally Identifiable Information. We use your Personally Identifiable Information to manage your account, to provide the Services, to maintain our customer/visitor lists, to respond to your inquiries or request feedback, for identification and authentication purposes, to send you administrative notifications (such as security, support or maintenance advisories), for service improvement, and to address issues like malicious use of the Services.

We may also use your Personally Identifiable Information to notify you about new features in the Services, and to send you general information about us and/or our partners.

We do not actively collect Personally Identifiable Information for the purpose of selling such information in a way that specifically identifies the individual (i.e. we don’t sell customer lists).

Biometric Information. We use your Biometric information to provide the Services, such as by providing you with health-related feedback, the establishment of activity goals, and other health aspects of the Services. We may also use your Biometric Information in a de-identified, aggregated, and anonymous way to monitor and analyze use of the Services, to increase the Services’ functionality and user-friendliness, and for the purpose of health research.

We do not use or disclose your Biometric Information to third parties for the purpose of advertising or marketing in any way. We do not share Biometric Data with third parties without user consent.

Usage & Analytics Information. We use your Usage & Analytics Information to administer and improve our Services to you. We may also use your Usage and Analytics Information in a de-identified, anonymous way in conjunction with an analytics service such as Google Analytics to monitor and analyze use of the Services, for the Services’ technical administration, to increase the Services’ functionality and user-friendliness, and to verify users have the authorization needed for the Services to process their requests.

Geo-Location Information. We use your Geo-Location Information to the provide certain aspects of the Services. In the future we may use this information to notify you about new features in the Services and to send you general information about us and/or our partners. We do not share Geo-Location Information with third parties without user consent.

If we plan to use this information in the future for any other purposes not identified above, we will only do so after informing you by updating this Privacy Policy.


We will share your Information as follows.

  • At Your Instruction. One purpose of our Services is for users to share information related to their use of the Services with other users. We allow you to choose the information you provide to other users but ask that you not disclose, any sensitive personal information (e.g. information related to racial or ethnic origin, political opinions, religion or other beliefs, genetic characteristics, trade union membership or criminal background)
  • Completion of Business Transactions. If you pay for the Services with a credit card or through your bank account, we may share your information with third party service providers in order to complete your purchase, but we will only share your information with these third parties as much as is necessary to do so.
  • Third Party Offers. We may allow other companies to offer you products and services, including offers through our Services, co-branded pages hosted by the third parties, or via email. Whether or not you decide to participate in such an offer is up to you. If you purchase a product or service on a co-branded page, or via a third party offer on our Services, that requires you to submit financial and personal information, you are also consenting to our delivery of this information to that party. The offer will notify you if any financial or personally identifiable information will be shared. Such third party will be authorized to use this information in keeping with our contractual relationship with them and in accordance with their own privacy policy and information practices. We do not control these third parties and you agree that we are not liable for their acts, or any failure to act on their part.
  • Third Party Advertising. We may use aggregated, statistical information to describe our membership and to establish advertising and other business relationships with third parties. We may serve you with targeted advertisements based on your personal or profile information, but we do not provide any of this personal or profile information to an advertiser or any third party with the exception of those uses expressly disclosed in this policy. However, if you click or view an ad on our Services then you consent to the likelihood that the advertiser will assume that you meet the targeting criteria, if any, used to display such ad, and as described above, you will be subject to the advertiser's privacy policy and information collection practices (if any).
  • Third Party Ad Servers. We may allow third party ad servers or ad networks to display advertisements on the Services. Some of these ad networks may place a persistent cookie on your computer or use other technologies such as JavaScript and web beacons. Doing this allows them to recognize your computer each time they send you an online advertisement. In this way, ad networks may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you. We do not have access to or control over the cookies that may be placed by these parties on your computer, and we have no control over these parties' privacy policies or information collection practices (if any).
  • Service Providers. We may sometimes use a third party to provide specific services on our behalf, including sending e-mails to our members, conducting member surveys, processing transactions or performing statistical analysis of our services. In these cases, we may provide certain personal information, such as your name and e-mail address and other financial information necessary for the service to be provided. However, these third parties are required to maintain the confidentiality of this information and are prohibited from retaining, sharing, storing or using this information for any other purposes.
  • Internet Service Providers. We may provide certain portions of your Personally Identifiable Information, such as your email address or name, back to your internet service provider if we have an existing advertising relationship with them. This is done to allow them to target or discontinue your exposure to our advertisements, once you have become a participating member of our Services. As part of our agreement with your internet service provider, they will be required to maintain this information in a confidential manner and use it solely for the purpose described in this Privacy Policy.
  • Business Transitions. In the event that we go through a business transition, such as a merger, acquisition, liquidation or sale of all or a portion of its assets, our information will, in most instances, be part of the assets transferred. Users will be notified of any such business transition via e-mail or prominent notice on the Services.
  • Legal Disclosure. We may disclose your Information if required to do so by law or in the good faith belief that such action is necessary to conform to applicable law, comply with a judicial proceeding, court order or legal process served on us or the Services, protect and defend our rights or property, or investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or violations of our Terms of Use.

Your choices regarding our use and disclosure of your Information: If you wish to opt-out of our sharing of your information with third parties for the third parties’ direct marketing purposes offline, please follow the instructions below.

  • Receiving electronic communications from us: If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out of receiving these marketing-related emails by sending a request for list removal to
  • Our sharing of your Personal Information with unaffiliated third parties for their (or their customers') direct marketing purposes: If you would prefer that we do not share your information on a going-forward basis with unaffiliated third parties for their direct marketing purposes, you may opt-out of this sharing by emailing from the email that you have signed up or used in receiving the Services.

We will try to comply with your request(s) as soon as reasonably practicable. Please also note that if you do opt-out of receiving marketing-related emails from us, we may still send you messages for administrative or other purposes directly relating to your use of the Services, and you cannot opt-out from receiving those messages.

California’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about businesses’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. Alternatively, such businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties’ direct marketing purposes if the customer has exercised an option to opt-out of such information-sharing. We are not an entity that is covered by the Health Insurance Portability and Accountability Act (“HIPAA”). The HIPAA privacy rules apply to health plans, health care clearinghouses, to any health care provider who transmits health information in electronic form in connection with transactions for which the Secretary of HHS has adopted standards under HIPAA and their service providers. This means that the information that you provide to us is not protected by the HIPAA privacy rules and regulations.


These Services are hosted in the United States and are intended primarily for visitors located within the United States. If you choose to use the Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you may be transferring your Personal Information outside of those regions to the United States for storage and processing. By providing your Personal Information through the Services, you consent to such transfer, storage, and processing.


The security of your Information is important to us. We use commercially reasonable efforts to store and maintain your Information in a secure environment. We take technical, contractual, administrative, and physical security steps designed to protect Information that you provide to us. Please keep in mind that if you directly disclose information through our public message boards, blogs, or forums, this information may be collected and used by others. You can log in to some of the Services using sign-in services such as Facebook Connect or an Open ID provider. These services will authenticate your identity and provide you the option to share certain information with us such as your name and email address to pre-populate our sign up form. Some services like Facebook Connect give you the option to post information about your activities via the Services to your profile page to share with others within your network.

In addition, when using some of our mobile applications we may allow you a chance to tell friends about our services by accessing the contacts in your Facebook or other social media account.


You may be able to share Personal Information with third parties through use of the Services. The privacy policies of these third parties are not under our control and may differ from ours. The use of any information that you may provide to any third parties will be governed by the privacy policy of such third party or by your independent agreement with such third party, as the case may be. This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any Third Party Offering, site or other products and services used in connection with the Services. We will keep your information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. Please note that if you request that your information be removed from our databases, it may not be possible to completely delete all of your information due to technological and legal constraints.
